Scrap Metal Dealer Waste Mangement Licensing Requirements

On May 1st 1994 a new waste management licensing act became law which required any operator who deposited, recovered or disposed of waste required a waste management licence (WML) or exemption. If you operated without either of these then you could be fined and sent to prison. A WML can be applied for and issued by the relevant regulatory authority usually SEPA or the EA.

When obtaining a licence, you are required to be a ‘fit and proper person' as well as being technically competent to do the job. A ‘fit and proper person' is someone without any environmental convictions, are technically competent and have taken all reasonable precautions to meet their licence requirements. A certificate of technical competence (COTC) is issued by the Waste Management Industry Training and Advisory Board (WAMITAB).

Metal recyclers do not face the full burden of waste legislation following heavy lobbying of government over the past 10 years. But they still face strict licensing controls and a less strict Duty of Care regime.

Metals recyclers in the UK either to have a licence to carry out their work or alternatively have to register for an exemption on grounds of size of business.

Over the past two years, and with the support of the metal recycling trade associations, the Environment Agency has been clamping down on unlicensed and non-exempt sites.

Licences issued under the Act are known as "Metal Recycling Site Licences". Licence conditions include security fencing, covered storage requirements, road and storage surfacing and drainage, sign and notice boards and other conditions.

A key element of the licensing and control system is Duty of Care. As a business, you have a duty to ensure that any waste you produce is handled safely and in accordance with the law. This is the ‘Duty of Care' and it applies to anyone who produces, imports, carries, keeps, treats or disposes of controlled waste from business or industry or acts as a waste broker in this respect. This involves the waste producer transferring a document to the waste disposer containing all relevant details about the waste.

But the practicalities of always obtaining this document and the fact that some suppliers might choose to go to merchants who did not enforce the rules rigorously prompted a change of heart on the part of the government in agreement with the Environment Agency which enforces the rules.

A concession was struck that the Environment Agency would not fully enforce the Duty of Care as far as the non-ferrous metal recycling industry in particular is concerned.

This concession was welcomed by the British Secondary Metals Association.

The Duty of Care rules apply to materials whether they are destined for recycling or disposal and the Environment Agency has said that the duty of care is the piece of legislation that links waste controls together linking waste with carriers.

There is now flexibility in the way the regulations are implemented for generally small loads of material. The Agency has given guidance saying that duty of care must be understood as a concept that requires all reasonable precautions to be taken so that waste, including metals, in the care of a business or carrier doesn't escape and is carried in a secure container.

When it is transferred to a registered broker, carrier, a business registered exempt and others there must be a description of that waste.

The agency accepts that it is clearly impractical to have a transfer note for every container of non-ferrous material, and if the way the notes are used allows the next person in the chain to be able to know what it is and handle it properly then the aim of the duty of care is in a large part being achieved.

Following the agreement with the British Secondary Metals Association earlier this year, the Agency will not generally take action especially as its resources have been focused on getting unlicensed or unregistered metal recycling sites into the licensing and exemption system.

The concessions on the duty of care apply to transactions where the total quantity of scrap metal being transferred does not exceed 1,500 kilogrammes. The transaction may cover a number of different metals but the total weight of the transfer must not be greater than 1,500 kg. This means that if the transfer weight of metals that are waste exceeds the 1,500 kg limit, then the waste transfer note must contain all the details as in the regulations.

An Easy to Use Kit
Your survival kit needs to be designed with your skills and handling skills in mind. For instance, a well traveled trekker will find it easy to handle a sophisticated, cutting edge survival kit that includes all modern gizmos. If you're not too comfortable with tools, on the other hand, you might want to look for an easy to use basic kit that doesn't requite too many High Tech skills to use.

A Fresh kit
Remember, even though items like food bars and water will come with a shelf life of many years, warehouse storage and bad transport conditions can decrease the life span of the items in your kit. While this doesn't mean that these items will be spoilt and fit to discard, it does mean that checking the expiration dates of the items in the kit is something you need to do seriously.

A Versatile Kit
Look for a kit that has at least a few tools that can be used for a number of purposes. For instance, duct tape is one those things that can be used in a dozen different ways, and so are large plastic garbage bags. After nearly seven years and billions upon billions of dollars spent on preparation, China is finally on the cusp of hosting its coming-out party: the 2008 Beijing Olympics.

Many of the steroids and other performance-enhancing drugs, like human growth hormone, that found their way into recent large-scale Drug Enforcement Agency raids have originated in China. It was not the first link from China to doping products. Members of past Chinese national track teams and swimming teams have been caught doping, after emerging from nowhere to win gold medals at world championships. Last August, systematic doping was found in two sports schools in China, where coaches were found to have given drugs to athletes as young as 15.

Now teams outside of China are wondering if these Chinese athletes, who feel so much pressure to win gold medals on their home soil, will compete clean. After the Athens Olympics began in 2004 with Greece's two track stars avoiding a drug test, will these Games also be marred by drug scandals?

Competitors, coaches and national federations are also wondering how China's pollution problem will affect the Olympics. The thick smog over Beijing could cause endurance events to be canceled or postponed. In 2001, the Chinese government planned to spend more than $112 billion on the improvement of air and water quality, but since then - with more factories and cars and less environmental regulation - it has only worsened.

Jacques Rogge, the International Olympic Committee president, said he is confident that the city and its environment will be ready for the competition. Still, the concerns over air quality have grown so grave that some nations are researching the use of masks by their athletes to filter the pollutants, if necessary.

Peter Ueberroth, the United States Olympic Committee chairman, also said all the question marks surrounding the Beijing Games will disappear once the Opening Ceremony begins the event Aug. 8. There is always panic about things before the Games begin, he said.

And so, athletes all over the world have already started to compete for spots on their Olympic teams, for a chance to make it to Beijing. The Olympic trials have begun. This time, all their work and sweat will be for more than an Olympic berth or a gold medal.

It will also be for an opportunity to see China, spit-shined for the Olympics, perhaps. It will be a chance to see a country revealing itself for the first time.

There are also 2 in 1 & 3 in 1 kits. I want to sell these models asap but will not let them go for nothing. They are old and in fair to excellent condition. Some are still factory wrapped. Each year for the past several years Congress has “fixed” the AMT problem by enacting a temporary “patch.”  With the signing of the stimulus bill this past February, 24 million taxpayers who otherwise would have been in the AMT in 2009 are spared – but only for one year.  Come January 1, 2010 these 24 million people again risk falling into the AMT.

What is this all about?  It’s simply another example of the law of unintended consequences.  When the first minimum tax was enacted back in 1969, it seemed like a good idea – 155 taxpayers making over $200,000 were paying no taxes at all under the regular income tax, so a “minimum” tax would make sure that they did. But today that 155 has exploded to over 4 million who are paying the AMT.  Unfortunately, this patch does nothing for the 4 million – it just keeps the other 24 million from joining this exclusive club.

Why is this happening?  The principal reason for this kudzu vine-like growth in the number of AMT victims is the failure to index the AMT for inflation, while the Regular Tax is so indexed.  The annual patch fixes this with a catch-up AMT indexing adjustment.

Why just a one-year patch and not a permanent fix?  The answer is simple economics – the revenue loss for the 2009 fix alone is 70 billion dollars.  A permanent fix, using Congress’ 10-year forecasting model, could approach a cost of nearly 1 trillion dollars. Now you’re starting to talk about real dollars.

Indexing

Under our system, tax brackets are progressive – i.e., the more you make, the higher your tax bracket.  Some time ago Congress decided it wasn’t fair to have you fall into a higher tax bracket if your only increase in income simply reflected inflation.  For example, in 2008 a single taxpayer hit the 33% bracket when taxable income reached $164,550.  In 2009, that same taxpayer can earn $171,550 before hitting 33% - a 4.3% increase.  Presumably the CPI increased by 4.3% during this same period.

For the Alternative Minimum Tax the level at which an AMT payer goes from the 26% bracket to 28% ($175,000) has not changed.  Instead, the Congressional fix is to index the AMT “exemption amount.”  For a single taxpayer, in 2008 the exemption amount was $46,200.  This is an increase of 4.2% over what it was the previous year, because of Congress’ 2008 patch.  If the patch is not enacted, however, the exemption amount reverts all the way back to what it was in 1993 for singles - $33,750.  This is the reason such a large number of taxpayers – 24 million – are left hanging out there every year.

Chrysler Confirms All New 300 and Dodge Charger

Chrysler LLC has been battered by high fuel prices this year, seeing sales plunge by 25% compared to 2007. This drop off isn't unique to Chrysler as the entire automotive industry is suffering, but for a company who relies on the North American marketplace for about 90% of its business, the downturn has been especially difficult to swallow.

Despite the ongoing bad news, Chrysler says that they have a number of cars in the pipeline that will help the automaker update its fleet and regain its position once the economy rebounds as expected by early 2010. Leading the way is its two largest cars – the Chrysler 300 and Dodge Charger – vehicles that will play an important role in Chrysler's long term success.

Though the market for big cars is way down, Chrysler expects that it will soon recover, perhaps just in time as it rolls out the next generation of the 300 and Charger in 2010. At first glance, not a whole lot will be different about the cars as the automaker is loathe to tamper styling success. Instead, vast improvements to interior quality, improved suspension, and a more economical powertrain combination will set these cars apart.

Chrysler won't be relying on just two cars to fuel its rebound, planning as many as nine new or improved models to make their debut before the end of 2010. In addition to the Chrysler 300 and Dodge Charger, other models expected include:

• A compact car built by Nissan for Chrysler. Reportedly, the Dodge Hornet concept – a Scion-like vehicle – will appear in early 2010, built by Nissan at its Mexican plant.

• Electric cars – one, two, three. Recently, Chrysler showed off three pre-production electric models, two of which are based on existing platforms: the Jeep Wrangler and the Dodge Caravan. The third model – a Dodge sports car – is a collaboration with Lotus and is likely to be the first of the three to make it to production. Similar to the Tesla Roadster, the Dodge EV will have an all-electric range of 150 to 200 miles and undercut the Roadster's $98,000 price tag.

• Hybrid cars – Chrysler was late to the hybrid game, having just recently launched hybrid versions of its large SUVs, the Chrysler Aspen and Dodge Durango. But, Chrysler plans to aggressively catch up and should have a hybridized version of its popular Dodge Ram pickup truck ready by 2010. Other hybrid models are being explored including for their popular minivans.

• Nissan again – If you don't see a pattern yet, you soon will. Chrysler is once again tapping Nissan to build a car for it, this time a midsize model at one of Nissan's Tennessee plants. This hook up will allow Chrysler to save money on product planning while allowing Nissan to maximize plant capacity.

Beyond 2010, Chrysler's fortunes may rely on additional business partnerships, perhaps signaling that the company will become the third leg on the Renault-Nissan stool. Long term, the automaker will need to rely on outside partnerships to ensure its success, a move that can be achieved by expanding current business relationships.
